If term of imprisonment of at least
one year is imposed, might be
deemed a “theft” offense; or if record
reflects loss to the government in
excess of $10,000, might be deemed
a “fraud” AF. But see Nugent v.
Ashcroft, 367 F.3d 162 (3d Cir.
2004) for arguments that a
conviction under this section would
only be an AF if term of
imprisonment of at least one year is
imposed and if record of conviction
reflects loss to the victim in excess of
$10,000.
Would probably be
considered a CIMT.
